Welcome to Wilkii, LLC d/b/a The Wilkii Club (“Wilkii,” “The Wilkii Club,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our websites, mobile applications, digital community, and physical products (together, the “Platform”). By joining The Wilkii Club, purchasing a membership, or using our Platform, you agree to these Terms. Please read them carefully.

1. Memberships and Subscriptions

  • Auto-Renewal: By subscribing, you agree that your membership will automatically renew each billing cycle until you cancel.

  • Billing: Your payment method will be charged on a recurring basis (monthly or annually, depending on your plan).

  • Cancellation: You may cancel anytime through your account settings or by emailing hello@wilkii.com before your next billing date. Once a payment has been processed, it is non-refundable.

  • Changes to Pricing: We may adjust membership pricing with advance notice. Continued use after the new rate takes effect constitutes acceptance.

2. Accounts, Security, and Conduct

  • To access certain features, you must create an account with accurate, current information. You are responsible for maintaining the confidentiality of your login and for all activity under your account.

  • You agree not to use the Platform to post, upload, or transmit any content that is unlawful, harmful, harassing, defamatory, discriminatory, or otherwise objectionable.

  • Wilkii reserves the right to suspend or terminate accounts that violate these Terms or community guidelines.

3. Shipping and Physical Products

  • Membership includes physical products (e.g., journals, base pads) which are shipped on a recurring basis.

  • Risk of loss passes to you once the package is delivered to the carrier.

4. Refunds and Returns

  • Membership payments are non-refundable once billed.

  • Physical products may be eligible for replacement if defective. Full details are in our Refund Policy.

  • Monthly subscription plans may be eligible for a refund only if cancelled within the first thirty (30) days of the initial purchase, as further outlined in our Refund Policy.

  • Quarterly subscription plans are non-refundable, including the initial purchase. Cancellation of a quarterly plan will only prevent future renewals and does not entitle the member to a refund or partial refund for the current billing period.

5. Intellectual Property

  • All Wilkii content, including the SHAPE™ framework, Growth Journey journals, digital materials, logos, trademarks, and community resources, are the exclusive property of Wilkii, LLC d/b/a The Wilkii Club and may not be copied, distributed, or used without our written consent.

  • By posting or submitting content to the community, you grant Wilkii a non-exclusive, worldwide, royalty-free license to display and use that content within the Platform.

6. Health and Lifestyle Disclaimer

  • Wilkii provides tools, frameworks, and resources for personal growth and lifestyle improvement.

  • We do not provide medical, psychological, financial, or legal advice. Results vary by individual, and no specific outcomes are guaranteed.

  • Always consult a qualified professional before making health, medical, or financial decisions.

7. Payments and Taxes

  • All fees are charged in U.S. dollars unless otherwise stated.

  • You are responsible for any applicable sales, VAT, or other taxes associated with your membership.

8. Limitation of Liability

  • To the maximum extent permitted by law, Wilkii is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

  • Our total liability to you for any claim will not exceed the total amount paid by you to Wilkii in the twelve (12) months preceding the claim.

9. Force Majeure

Wilkii is not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, supply chain disruptions, strikes, or technology outages.

10. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of the State of Delaware, U.S.A.

  • Any disputes shall be resolved in the state or federal courts located in Delaware, and you consent to that jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will notify you by posting the revised Terms on our website or emailing you. Continued use of the Platform after changes are posted constitutes acceptance.
