Consumer Health Data Privacy Notice

Effective Date: September 2, 2026

This Consumer Health Data Privacy Notice supplements the Wilkii Privacy Policy and applies where consumer health data privacy laws apply, including laws that may protect health-related information outside HIPAA. If this Notice conflicts with the general Privacy Policy as to covered consumer health data, this Notice controls for that data.

3.1 What Is Consumer Health Data?

“Consumer Health Data” means personal information that is linked or reasonably linkable to an individual and identifies or may reveal or be used to infer that individual’s past, present, or future physical or mental health status, as defined by applicable law.

3.2 Consumer Health Data Wilkii May Collect

Depending on how you use Wilkii and what you choose to enter, Consumer Health Data may include:

  • Information about emotions, stress, mood, mental or emotional wellbeing, or self-regulation.

  • Personal reflections, Clarity Loop entries, Regulate responses, notes, or journal-style content that identifies or could be used to infer physical or mental health status.

  • Habit, wellbeing, lifestyle, or behavioral information that may reveal or be used to infer health status.

  • Information you voluntarily provide to Support or the Help Agent about symptoms, diagnoses, treatment, medications, mental health, physical health, or other health-related matters.

  • Information from a health or wellness integration if Wilkii later offers one and you choose to connect it.

  • Inferences derived from information above when used to identify or associate you with a physical or mental health status.

3.3 Sources

We primarily collect Consumer Health Data directly from you when you use Wilkii features, submit content, communicate with Support, or choose to connect an integration. We may also receive data from service providers acting on our behalf or integrations you direct to share information with Wilkii.

3.4 Why We Collect and Use It

  • Provide the Wilkii features and experiences you request.

  • Save your reflections, progress, preferences, and history.

  • Personalize or organize the Services where permitted.

  • Respond to support questions and troubleshoot the Services.

  • Protect account, community, and platform safety and security.

  • Improve and maintain Wilkii, including through aggregated or de-identified analysis where appropriate.

  • Comply with law and enforce Wilkii policies.

3.5 Sharing of Consumer Health Data

Wilkii may share Consumer Health Data only as reasonably necessary to provide the Services, with your consent where required, or as otherwise permitted by applicable law. Categories of recipients may include service providers supporting hosting, authentication, customer support, security, analytics, AI-enabled features, and other operations; professional advisers; integrations you direct us to use; and authorities or other parties where legally required.

Wilkii does not sell Consumer Health Data. Wilkii does not use Consumer Health Data for targeted advertising.

3.6 Consumer Health Data Rights

Where applicable, you may have the right to:

  • Confirm whether Wilkii collects, shares, or sells Consumer Health Data.

  • Access Consumer Health Data and, where required, obtain information about third parties with whom it has been shared.

  • Correct or request changes to Consumer Health Data.

  • Withdraw consent to certain collection or sharing.

  • Request deletion of Consumer Health Data, subject to legal exceptions.

  • Appeal a denial of a request where applicable.

Submit requests to privacy@wilkii.com. Wilkii may need to verify your identity. We will respond within the time required by applicable law.

3.7 Washington Residents

If the Washington My Health My Data Act applies to Wilkii’s processing of your Consumer Health Data, you may have rights to access, delete, correct, withdraw consent, and obtain information about sharing. Wilkii will not sell Consumer Health Data without a valid authorization where such authorization is required.

If Wilkii denies an applicable request, you may have a right to appeal. Information about Washington consumer-health-data rights may also be available from the Washington State Attorney General.

3.8 Nevada Residents

If Nevada’s Consumer Health Data Privacy Law applies, Wilkii will provide the disclosures and rights required by that law, including applicable access, correction, deletion, consent, appeal, and third-party collection disclosures.

3.9 Connecticut and Other States

Other state laws may regulate Consumer Health Data or sensitive health-related information. Where applicable, Wilkii will obtain consent, enter required processor agreements, honor applicable rights, and comply with restrictions on sale, sharing, or processing.

3.10 Third-Party Tracking

Wilkii does not intentionally permit third parties to collect Consumer Health Data across unrelated websites or services for targeted advertising. Website analytics or marketing technologies should be configured to avoid sending sensitive health-related content, free-text reflections, or similar Consumer Health Data to advertising platforms.

3.11 Changes and Contact

We may update this Notice as permitted by law and will provide notice of material changes when required.
